Just in the USA, millions of people join in marriage each year. Even though every couple believes their relationship will endure, as many as half of all marriages end in divorce. This leaves the partners on their own to navigate through emotional and legal battles.

While breaking up a marriage is not new, it is now more acceptable. Divorce has become easy in modern society. In some Western countries, there is no longer even the need for an at-fault party. Still, the array of choices can seem overwhelming to someone beginning the process. Where could they possibly begin? What is the first thing to do when someone has decided to get a divorce?

First things first- think things through. Examine your goals, and make sure your making the right decisions for the future. Financial assets should be completely inventoried if so. Debt repayment is a trouble some procedure.It is best to pay as much as possible to avoid any unpleasant situations.Do not try for any new debt till you get a signal from the authorities as they may begin the proceedings to help you out from the present unfortunate situation. Avoid legal entanglements such as refinancing a family home- assets should be kept as liquid as possible, to allow for easier negotiation later. Make sure that if a spouse’s insurance provides for the entire family that it is possible to set up separate insurance. Considering a consultation with a lawyer once a better idea has been agreed one. They can help you make decisions about divorce and estimate your expenses.

If the jurisdiction in which the couple lives allows it, they might file proceedings as no-fault. There is no need for cooperation, nor the ability for hindrance, when one spouse chooses to leave the other. Individuals who want a divorce may find this option easy and easier if there is no property to be split between the couple. In jurisdictions without this option, things may be a little more complicated, but not necessarily so, as long as both spouses see eye-to-eye on wanting the separation, and the split of property following it. A spouse that does not wish to proceed may charge that the divorce is groundless, resulting in a costly, drawn-out, legal case. Though judges rarely accept these claims, they can drag out proceedings.

When children are involved, it becomes about much more than dividing assets and separating from one another. Most parents who no longer want to be married still want what is best for the children. The difficulty lies in deciding what is best. The custody arrangements will be different for every family. When parents are still on fairly good terms with each other, they may not require the structure of formal legal arrangements. Some couples may choose nearly equal custody- with children splitting their time between each parent. Some alternate with weekend and weekday living arrangements for children. Court battles are difficult for both parents and children, so it is good to have an idea of what each party desires before litigation begins.

A lot of work remains to be done even after the divorce is finalized and legal arrangements have been made. If you are paying child support, keep records of all payments. Property should be divided up as equally as possible. While at first you may want to hurt your now ex, this is not a productive choice and will just make it harder for you and them to heal.

No one steps into marriage expecting it to fail, but many do. Though a marriage has ended, the world still turns. Stay as calm as possible, stay informed, and it may be that at the end of the process, as stressful and painful as it may be, everything will have worked for the greater good.
